1. Introduction
These Terms and Conditions govern the use of the AI AD ENGINE website, platform, advertising tools and related services (the “Services”).
By accessing AI AD ENGINE, subscribing to a plan or using the Services, the customer agrees to these Terms and Conditions.
AI AD ENGINE provides technology, tools and related services designed to assist businesses with the creation, launch, management and optimization of digital advertising campaigns across supported platforms including Meta, Facebook, Instagram, Google and TikTok.
AI AD ENGINE International operates at aiadengine.app and serves customers internationally. The South African business at aiadengine.co.za is a separate site with its own pricing and its own terms.
2. Who may subscribe
The Services are provided for business use.
By subscribing, the customer confirms that they are at least 18 years old and that they are subscribing on behalf of a business or in a business capacity.
The customer is responsible for ensuring that their use of the Services is lawful in their own country.
3. Subscription plans
AI AD ENGINE currently offers:
- Scale — $49 per month
- Dominate — $99 per month
Prices are stated in United States dollars.
Depending on the customer's location, the payment provider may display or charge an equivalent amount in a local currency. Currency conversion, and any conversion fee applied by the customer's bank or card issuer, is a matter between the customer, their bank and the payment provider.
Any sales tax, value added tax or similar tax that applies in the customer's country may be added at checkout.
Subscriptions are billed monthly in advance.
Subscriptions operate on a month-to-month basis unless otherwise expressly agreed in writing.
There is no long-term contract and no minimum subscription term.
4. Automatic renewal
Subscriptions automatically renew monthly until cancelled.
By subscribing, the customer authorises the recurring monthly payment associated with the selected plan.
Customers are responsible for cancelling before their next renewal date if they do not wish to continue.
5. Advertising spend
AI AD ENGINE subscription fees do not include advertising or media spend.
Advertising budgets paid to Meta, Facebook, Instagram, Google, TikTok or another advertising platform are separate from the AI AD ENGINE subscription and are paid directly to those platforms.
The customer remains responsible for those charges.
6. Third-party platforms
AI AD ENGINE uses and connects with third-party services and advertising platforms.
These may include Meta, Facebook, Instagram, Google, TikTok and other software and technology providers.
Customers remain subject to the respective terms and policies of those third-party providers.
AI AD ENGINE cannot be held responsible for circumstances outside its reasonable control, including:
- Third-party outages
- Advertising account restrictions
- Advertising account suspensions
- Advertisement rejections
- Platform policy changes
- Algorithm changes
- Third-party technical failures
7. No guarantee of results
AI AD ENGINE provides advertising software, technology and related assistance.
AI AD ENGINE does not guarantee any specific number of:
- Leads
- Customers
- Sales
- Revenue
- Appointments
- Clicks
- Impressions
- Return on advertising spend
Advertising results depend on many factors, including:
- Industry
- Market
- Location
- Competition
- Advertising budget
- Offer
- Pricing
- Creative
- Website or landing page
- Sales process
- Customer follow-up
- Consumer demand
- Third-party advertising platform algorithms
Case studies, testimonials and previous customer results are provided as examples. They do not guarantee that another customer will achieve the same or similar results.
8. Customer responsibilities
Customers remain responsible for:
- Products and services they advertise
- Accuracy of advertising claims
- Offers and promotions
- Advertising budgets
- Customer communications
- Advertising account access
- Third-party advertising accounts
- Legal and regulatory compliance in their own country
- Sales and fulfilment
Customers may not use AI AD ENGINE to advertise unlawful, fraudulent, misleading or prohibited products or services.
9. Scale plan
Scale is primarily a self-service subscription.
The customer remains responsible for using the platform and supplying the required business and advertising information.
10. Dominate plan
Dominate includes additional assistance alongside the platform.
That assistance does not constitute unlimited advertising agency services, unlimited campaign creation or unlimited campaign management.
Customers remain responsible for supplying requested information, account access, approvals and advertising budgets.
11. Payments
Payments are processed by Whop, or another payment provider selected by AI AD ENGINE.
Card details are entered with the payment provider and are not collected or stored by this website.
By subscribing, the customer authorises recurring monthly subscription payments until the subscription is cancelled.
If a renewal payment fails, access to the Services may be suspended until payment is successfully collected.
12. Cancellation
Customers may cancel their subscription at any time.
Cancellation prevents future renewal charges.
Except where otherwise required by law applicable to the customer, cancellation does not ordinarily result in a refund for a billing period that has already commenced.
Where applicable, access to the Services may continue until the end of the period already paid for.
13. Refunds
Refunds are governed by the AI AD ENGINE Refund & Cancellation Policy.
Except where applicable law requires otherwise, subscription fees for a billing period that has already commenced, and for which the Services have been activated or made available, are non-refundable.
14. Account suspension or termination
AI AD ENGINE may suspend or terminate access where a customer:
- Fails to pay subscription fees
- Uses the Services unlawfully
- Violates third-party platform policies
- Engages in fraudulent activity
- Attempts to abuse the platform
- Materially breaches these Terms
15. Intellectual property
AI AD ENGINE branding, website content, documentation, graphics, processes and proprietary materials may not be copied, reproduced, resold or distributed without permission.
Third-party software, trademarks and platforms remain the property of their respective owners.
Customers keep ownership and control of their own advertising accounts, advertising assets and business content.
16. Limitation of liability
To the maximum extent permitted by applicable law, AI AD ENGINE shall not be liable for indirect, consequential or special losses arising from the use of the Services, including lost profits, missed opportunities or losses resulting from decisions made by third-party advertising platforms.
Nothing in these Terms excludes any liability or statutory consumer right that may not lawfully be excluded.
17. Changes to the Services
AI AD ENGINE may modify, improve, replace or discontinue platform features where reasonably necessary.
18. Changes to these Terms
These Terms may be updated from time to time to reflect changes to the Services, technology or legal requirements.
The current version is always published at aiadengine.app/terms, with the date it was last updated shown at the top of the page.
19. Privacy
Personal information is processed in accordance with the AI AD ENGINE Privacy Policy and applicable data protection law, which may include the EU General Data Protection Regulation, the UK GDPR and United States state privacy laws, depending on where the customer is located.
20. Governing law
These Terms are governed by the laws of the jurisdiction in which AI AD ENGINE International is established, without regard to its conflict of law rules.
Nothing in these Terms is intended to exclude, restrict or override any statutory consumer right that cannot lawfully be excluded under the law applicable to the customer, including the mandatory consumer protections available to customers in the European Union and the United Kingdom.
